1. Definitions

• "Mistborne" refers to the business operating at 3 Jalan Marina, 79100 Iskandar Puteri, Johor, Malaysia
• "Guest" / "You" refers to any individual who contacts Mistborne, makes a booking, or participates in a tour
• "Tour" / "Service" refers to any of the yacht tour experiences offered by Mistborne
• "Booking" refers to a confirmed reservation for a tour, communicated in writing by Mistborne
• "Agreement" refers to these Terms and Conditions as accepted by the Guest

2. Acceptance of Terms

By submitting an enquiry form on this website, emailing us, or making a verbal booking, you agree to be bound by these Terms and Conditions. These terms form the agreement between you and Mistborne for the provision of yacht tour services.

You must be at least 18 years of age to make a booking. Guests who are minors may participate in tours when accompanied by an adult who accepts these terms on their behalf.

3. Service Description

Mistborne offers the following yacht tours from Puteri Harbour Marina, Iskandar Puteri:

• Johor Strait Morning Cruise — approximately 3 hours, MYR 1,100
• Desaru Coast Full Day — full day, MYR 2,850
• Eastern Johor Overnight Expedition — 2 days / 1 night, MYR 4,800

All prices are stated in Malaysian Ringgit (MYR) and include the items specified on our Solutions page. Tour descriptions are provided for guidance and may vary based on conditions and operational decisions made in the interest of guest safety.

4. Booking and Confirmation

A booking is confirmed only when Mistborne provides written confirmation (by email or message). Until such confirmation is received, availability is not guaranteed.

We recommend enquiring at least five to seven days in advance for day tours, and at least two weeks in advance for the overnight expedition.

5. Payment

Payment terms are communicated at the time of booking confirmation. Full payment is typically required prior to departure. We currently accept bank transfer and cash payment at the marina. Credit and debit card acceptance may be available — please confirm at time of booking.

All prices are subject to change without notice until a booking is confirmed in writing.

6. Cancellation and Rescheduling

Cancellation by Guest:

• Cancellation more than 7 days before departure: full refund minus any processing costs
• Cancellation 3–7 days before departure: 50% refund
• Cancellation less than 3 days before departure: no refund

Cancellation by Mistborne: If we cancel a tour due to unsafe weather conditions, mechanical issues, or other circumstances beyond our control, guests will be offered a full rescheduling at no additional charge, or a full refund. We do not accept liability for costs arising from travel arrangements made by guests in connection with a cancelled tour.

7. Guest Responsibilities

• Arrive at the marina at the agreed departure time. Late arrival may result in forfeiture of the tour without refund.
• Follow all safety instructions given by the captain and crew
• Disclose any medical conditions, mobility limitations, or serious allergies prior to departure
• Behave responsibly onboard and refrain from endangering others
• Guests who are visibly intoxicated at departure may be refused boarding without refund

8. Health and Safety

Participation in Mistborne tours involves activities on open water. By booking, you acknowledge that marine conditions can be variable and that some degree of physical activity (boarding, movement on deck) is involved.

The captain retains full authority to modify or abort a tour route at any time for safety reasons. Decisions made in the interest of guest and crew safety are final and not subject to refund unless the tour is cancelled entirely before departure.

9. Intellectual Property

All content on this website — including text, images, and design — is the property of Mistborne or its licensors. No part of this website may be reproduced or used commercially without written permission.

10. Disclaimers

Tours are provided on an "as available" basis. Mistborne does not make specific commitments about wildlife sightings, water visibility, or other natural conditions that cannot be controlled. Descriptions of tour experiences reflect typical conditions and are not contractual guarantees.

11. Limitation of Liability

To the maximum extent permitted under Malaysian law, Mistborne's liability to any guest shall not exceed the total amount paid by that guest for the specific tour in question. We are not liable for indirect, consequential, or incidental losses including travel costs, lost business, or personal expenses incurred in connection with a cancelled or modified tour.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from a booking or from participation in a Mistborne tour shall be subject to the exclusive jurisdiction of the courts of Johor, Malaysia.

We encourage guests to contact us directly in the first instance to resolve any concern informally before pursuing formal proceedings.

13. Changes to These Terms

We may update these Terms from time to time. Updated terms will be posted on this page with a revised "Last Updated" date. Terms in effect at the time of your booking confirmation will apply to that booking.
